City seeks partners to host City-owned parklets for 2022 season

The City of Minneapolis is seeking community partners to host City-owned parklets for the 2022 season. Parklets are unique public gathering spaces built in the right-of-way with seating, plantings and other amenities.

Neighborhood organizations, street-level businesses, nonprofits, community organizations and Special Services Districts are encouraged to apply to host a City-owned parklet. The application deadline is Friday, April 8. The City has three parklets to find hosts for.

City crews will set up the parklets at host locations in the spring after street sweeping is completed and will remove them in the fall. The City-owned parklets include the parklet structure (platform and planter boxes), plantings, chairs, tables, patio umbrellas and public parklet signage. Hosts are responsible for day-to-day maintenance, such as watering plants, picking up trash, talking down umbrellas on windy days, locking up tables and chairs when not in use and reporting any issues.

In 2021, City-owned parklets were hosted at the following businesses: Dollar & Up, 3653 Chicago Ave.; Butter Bakery Café, 3700 Nicollet Ave.; and Dancing Bear Chocolate, 4367 Thomas Ave. N.

The goal of the parklet program is to activate community corridors with fun public spaces that make neighborhoods more vibrant and support local businesses. Find more information about the parklet host application process on the City’s website or by contacting parklets@minneapolismn.gov.

Advice for Food & Drink Establishments to Manage Vaccine Verification

Do I need to check for proof of vaccination or negative test at the door?

It is up to each business to implement a process that makes sense for their service model.

We recommend posting signage requiring proof of vaccination or a negative test at each point of entry. Some sample approaches to consider:

Restaurants with a host stand: Check for proof of vaccination or a negative test when a customer checks in.
Restaurants without a host stand: Check for proof of vaccination or a negative test by the server at the first interact with a seated customer.
Counter service: Check for proof of vaccination at the point of ordering when asking if a customer would like their order for dining in or if it’s a to-go order.
Bars: Check for proof of vaccination or a negative test at the door along with IDs, or bartender asks at the bar when the customer sits down.
Venues with ticketed events: Check for proof of vaccination or a negative test at the point of entry when checking tickets and/or IDs.
Catering/Rental Halls: For rental halls with private events (e.g. weddings) an event coordinator can work with the party to communicate the standards for the venue. They may choose to work with the event planner or host to gather proof of vaccination in advance of the event or identify staff to verify at the point of entry to the event.

The City updated signs to clarify only customers eating or drinking indoors need to show proof of vaccination or a negative test. If customers are picking up food for take-out or will only be inside for less than 15 minutes, they do not need to show proof.

Get Some Grant $$ for Wast Prevention Efforts

Waste Prevention Grants Available to Businesses and Non-profit Organizations

Hennepin County has a grant program for projects that prevent waste in the business sector. Areas of focus include replacing disposables with reusables, food waste prevention and innovative projects around research and development (to prevent waste). This year $300,000 is available for business waste prevention grants. Applicants may apply for up to $50,000 toward a project, with a minimum of $5,000. Grants over $10,000 require a 25% match. Review the 2022 waste prevention grant guidelines (PDF) and the grant flyer (PDF) for details on this grant program.

Applications will be accepted on an ongoing basis until Monday, November 14, 2022, or until the annual program budget is exhausted, whichever occurs first.

Minneapolis Public Schools Seeks Proposals from Farms and Organizations for Sustainably Grown and Raised Foods

Minneapolis Public Schools (MPS) is now seeking bid proposals from farms and organizations interested in selling sustainably grown and raised foods to the school district’s Farm to School Program for the 2022-2023 school year. This year’s expanded RFP includes a wide variety of vegetables and fruits, free-range chicken and turkey, grass-fed beef, dried legumes, rolled oats, wild rice, and more.

Bag Fee Enforcement Restarts Tomorrow

Businesses providing a bag to customers at the point of purchase must charge a minimum 5 cent fee per bag and itemize this on receipts. NEW MN DEED Covid Relief Grants - Applications Accepted Beginning Sept 20

The Minnesota Department of Employment and Economic Development (DEED) will begin accepting applications for the Main Street COVID Relief Grants Program on September 20th. A total of $64,200,000 is available in grants for Minnesotan owned and operated businesses that can demonstrate financial hardship due to the COVID-19 pandemic. Businesses that are majority-owned by military veterans, women, and Black, Indigenous, and people of color individuals; employ 6 people or fewer; and/or did not receive previous assistance from other state relief programs will be prioritized in the selection process. Funding will be distributed in a 50/50 split between the Twin Cities metro area and Greater Minnesota.

SBA Assistance Updates

ECONOMIC INJURY DISASTOR LOAN (EIDL) UPDATE

The Small Business Administration (SBA) began the COVID-19 Economic Injury Disaster Loan (EIDL) program at the start of the pandemic. The SBA announced they have increased the maximum amount small businesses and non-profit organizations can borrow through the program. The SBA has raised the loan limit from 6-months of economic injury with a maximum loan amount of $150,000 to up to 24-months of economic injury with a maximum loan amount of $500,000.

If you’re a business that has received a loan at the current limits, you do not need to submit a request for an increase. The SBA will reach out to you via email to provide more details about how to request an increase. Any new loan applications submitted going forward will be automatically considered for the new loan parameters.

You can apply for the EIDL program here, and you can email your questions to DisasterCustomerService@sba.gov or call the the SBA at 1-800-659-2955.

Also, effective immediately, applicants can send a request for reevaluation of a Targeted EIDL Advance application that was declined to the following email address: TargetedAdvanceReevaluation@sba.gov.

Applicants should follow these instructions when requesting a reevaluation:

Send an email to TargetedAdvanceReevaluation@sba.gov
Use the subject line “Reevaluation Request for [insert your 10-digit application number]”
In the body of the email, include identifying information for the application such as application number, business name, business address, business owner name(s) and phone number
Important: Include an explanation and any documentation that addresses the reason for the decline, if available. SBA will contact applicants if additional documentation is required to complete the review.

SAVE OUR STAGES

Among the hardest hit small businesses throughout the pandemic have been live venues, performing arts organizations, museums, and movie theaters. The Shuttered Venue Operators Grant, otherwise known as the Save Our Stages Grant, is an SBA grant program that directly targets these businesses for relief. This program includes over $16 billion in grants to shuttered venues. Eligible applicants may qualify for grants equal to 45% of their gross earned revenue, with the maximum amount available for a single grant award of $10 million. $2 billion is reserved for eligible applications with up to 50 full-time employees.

Unfortunately, the application portal had been temporarily suspended due to technical difficulties. I am pleased to announce that the Shuttered Venue Operators Grant application portal will reopen on April 24. In the meantime, applicants can register for a new account here.

RESTAURANT REVITALIZATION FUND (RRF)

The RRF is designed to provide emergency assistance for eligible restaurants, bars, and other qualifying businesses. While the SBA is not yet accepting applications, you can prepare by reviewing the sample application, program guide, and cross-program eligibility chart here. You will be able to apply through SBA-recognized Point of Sale Restaurant Partners or directly via SBA in a forthcoming online application portal. If you haven’t already, sign up for RRF email updates here.

The official application launch date will be announced shortly. Ahead of the application launch, and over the next two weeks, the SBA will provide outreach and training on how to apply, application requirements and where to apply.

For the first 21 days that the program is open, the SBA will prioritize reviewing applications from small businesses owned by women, veterans, and socially and economically disadvantaged individuals. Following the 21-day period, all eligible applicants are encouraged to submit applications.

Covid Restrictions Easing on Monday

Governor Walz announced big “dial turns” this morning, loosening work from home requirements beginning April 15 as well as removing some restrictions March 15 as COVID cases continue to decline and more Minnesotans get vaccinated.

Masking and Social Distancing Remains In Place

Changes Beginning at NOON on March 15th:

Restaurants can go to 75% with bar seating allowed for groups of 4
Gym capacity moved to 50%
Salon and Personal Services capacity limits are removed
Indoor events and entertainment can open at 50% capacity, with no more than 250 people.
Outdoor events and entertainment can open at 50% capacity, with no more than 250 people
Capacity limits on places of worship are lifted
Household gatherings of 50 permitted outdoors and 15 indoors with no limit on number of households

Changes Beginning on April 1st:

Indoor events and entertainment venues with occupant capacity greater than 500 may increase capacity per state guidelines
Outdoor events and entertainment venues with occupant capacity greater than 500 may increase capacity per state guidelines

Changes Beginning on April 15th:

Workers may return to work in person, but remote work is still strongly encouraged

Bar Service is Back!

Today, Mayor Jacob Frey announced he will rescind the ban on seating at bar counters in Minneapolis businesses, effective immediately. The decision to remove the restrictions was based on public health data. Public health officials will continue to monitor COVID-19 data trends in the City.

With the City regulation rescinded, businesses must follow requirements in the State Emergency Order 2021-01 for bar seating. Highlights include:

Reservations are required
No more than two customers may be seated together at a bar counter at any one time
Identify a specific location at the bar counter for customers to place orders
Physical distancing of 6 feet must be maintained between:
- Customers in line to order at a bar counter, Customers ordering at a bar counter and customers seated at the bar counter, and Parties seated at a bar counter
- There is to be no congregating at the bar counter
- If customers pick up their order at a bar counter, they must return to their table or bar seating to eat or drink
Provide floor markings and signage at the designated bar counter service area
Increase the amount of fresh air circulating in the bar by opening fresh air intake dampers and keeping HVAC fans running to dilute and disperse air particles

Council Votes Tomorrow On Funding For Officer Recruits

Tomorrow morning, Council will vote on whether to approve funding for recruitment classes in August and December that would add around 100 officers to the depleted Minneapolis Police Department. The MPD is currently understaffed and having difficulties addressing the issues in the city that do require police response. We are asking you to call or email your council member to urge support for the recruitment classes ahead of tomorrow's vote.

Background Information:

During the City of Minneapolis 2021 Budget process, the City Council approved a General Fund reduction of $6,427,000 from the Mayor's proposed budget of the Minneapolis Police Department (MPD). The reduction is based on the budgeted cost for the Community Safety Officer program and the planned second and third recruit/cadet class for 2021. The reduction redirects funds to a Public Safety Staffing Reserve held within Finance and Property Services by the City's Chief Financial Officer. The City’s Police Chief can access the funds in the reserve by submitting a report to the appropriate City Council Committee detailing current staffing levels, future anticipated staffing needs, and the plan to deploy funds. The aim of the staffing reserve is to ensure that recruitment and staffing strategies comport with broader City goals. It gives City Council the opportunity to ask questions of MPD and allows the Police Chief an opportunity to explain his hiring strategy for the Department.

The MPD has seen a significant reduction in active law enforcement personnel in 2020/2021 due to higher than anticipated attrition and leaves resulting in difficulty in meeting the public safety needs of the City. Budgetary constraints, the lengthy lead time needed for hiring and training new recruits, and recent crime trends have aggravated the situation.

The following activities will help meet the need for the additional deployment of law enforcement personnel.

Community Service Officers (CSO) work part-time for MPD while attending an accredited law enforcement program, or training/ for licensing requirements. Upon completion of the program and during the next academy opportunity, CSOs graduate into the MPD's Recruit Academy program. CSO classes most closely represent the Community, and play a multifaceted role in the MPD, assisting patrol officers in non-enforcement activities, responding to requests for service, maintaining department equipment, and assisting with traffic control (among other tasks). Between 1/2000 – present, 45.94% of CSOs identify as BIPOC, a significantly higher percent than other hiring classes.
The MPD has two Recruit classes and one Cadet class planned for 2021. MPD seeks to train a total of 104 new officers with these three classes in an effort to stabilize MPD’s sworn workforce and help meet the public safety needs of the City. The additional hiring classes will help ensure the Department’s ability to provide basic 911 service and to help replenish other units impacted by the unexpected attrition including Investigations.

We Need to Hear From You: Monthly Crime Data

We're hearing about a number of overnight break-ins, including a couple this weekend. Suspects are gloved and covered, leaving little evidence to track them down. They seem to be going for cash drawers and a quick entry-exit. Leaving your registers visibly empty and/or a note near the door indicating that no cash is kept on-site overnight may be a good idea.

Reducing crime in the area is one of our top priorities this year, and we need your help to put pressure on the city for improvements. Please provide information about incidents that have happened to you or near you so that we have a complete picture of what is happening in the district.

Information you provide will be kept confidential, and will be used to discuss crime with Council Members, the 5th Precinct, and the Press in a multi-pronged advocacy effort to bring attention to and reduce the issues we are currently facing.

More Financial Relief May Be On the Way Soon

Both the Minnesota and Federal legislatures are working on relief packages for businesses that may be passed as early as this week. Both aim to have aid available before the end of the year. SWBA is monitoring progress and will report on these as soon as possible. Here's to hoping that the vaccines that are making their way out this week are the light at the end of the tunnel and that we can return to a more normal level of community and business soon.

Public Comment Period on Public Safety Ends Next Week

Take survey by Dec. 18 on transforming community safety

Provide your input on what community safety looks like and tell us your ideas about a new model of community safety for Minneapolis. You can take the survey in English, Spanish, Somali, Hmong or Oromo.

The survey has been extended to Dec. 18 to hear from more voices for the first phase of survey results, which is planned to be presented to council in early January. Input provided after Dec. 18 will continue to be used for future engagement phases.

In June 2020, the City Council pledged to create a new model of community safety. As part of that, the council committed to a yearlong process of community engagement. This survey is one of the first steps in that process. Through the survey, you can share your vision for a new community safety model. You can also provide ideas for how to accomplish that new model.

Exterior Shutter Ordinance Passes Council

Council finally passed the Exterior Shutter ordinance last week, officially allowing commercial properties to add exterior security shutters to their buildings if desired. The ordinance remained very simple, stipulating only that the shutters be retractable and remain open during business hours, and that no advertising may be placed on them. MONTHLY UPDATE. Overall, the map is showing fewer incidents in the Southwest district than we were seeing over the summer. Vehicle thefts and thefts from vehicles continue to be the most prominent issues throughout the district. North of 36th St and East of the lake sees much heavier criminal activity than the rest of Southwest. Mark Anderson is Executive Director of the Barbara Schneider Foundation, an organization named for a woman who was tragically killed by responding officers in the year 2000 in her own home when she was in mental health crisis. The Foundation works with police, jails, hospitals, social workers, educators, local government, courts and community members to improve the response to individuals who are in mental health crisis and to prevent crisis. He was a policy aide to U.S. Senator Paul Wellstone from 1990-2002 on all his mental health, health care and human rights reform initiatives in the US Senate and has been the founding Executive Director of the Barbara Schneider Foundation since 2002.

Xcel Energy is committed to helping businesses get back on their feet after being affected by the COVID-19 pandemic or civil unrest, and a new program coming soon will help provide some relief to businesses that were hard hit. Small businesses that saw an electric load decrease of 25% or more as a direct result of the pandemic or civil unrest may qualify for a 25% discount on the base energy and demand charges on their Xcel Energy electric bill from Jan. 1 through Aug. 31, 2021. Love Local Campaign to Support Local Businesses

Businesses are an essential part of what makes communities thrive, and local businesses need our support now more than ever. In response to the challenging economic impacts of COVID-19 on small businesses, Hennepin County is working with 11 cities to roll out the Love Local Initiative, an effort using county-allocated CARES Act funding to encourage people to shop at their local business districts while following COVID-19 safety guidelines.

One component of the effort is a marketing campaign encouraging people to support their small businesses while reducing the risk of contracting or spreading COVID-19 by:

Shopping online when possible
Ordering takeout from local restaurants
Shopping with one person per household at a time
Always properly wearing a mask
Maintaining social distance

The love local initiative is also coordinating public space improvements to help with COVID-19 safety and overall shopping experience including outdoor heaters, hand sanitizing stations, and more.

As public health guidance continues to change, the Love Local Initiative is responding as quickly as possible to be consistent with the latest COVID-19 public health recommendations and guidelines.

NEW: Small business relief for restaurants, bars, fitness, event and entertainment venues

The rapidly increasing number of COVID-19 cases throughout the state of Minnesota has required new public health measures to reduce the spread of the virus, including restrictions on restaurants, bars, gyms, and other fitness, event, and entertainment venues.

Starting Monday, November 23, businesses can apply for new grant funding to mitigate the economic impacts of COVID-19.

Businesses that have not previously received Hennepin County Small Business Relief funds can apply for grants up to $15,000.
Businesses that have received Hennepin County Small Business Relief funds can apply for additional grant funds up to $10,000.

Eligible businesses:

Restaurants/food service establishments
Bars/drinking places
Fitness centers/gyms
Event and entertainment venues

close bars and restaurants at 10 p.m. (takeout service may continue later)
reduction in total capacity in bars and restaurants to either 150 people or 50%
Group gatherings will be limited to 10 people, indoors and outdoors, from no more than three households. 3 households or less. Must maintain social distancing, wear masks.
25 person limit to celebrations (weddings, funerals, etc). Must end by 10 p.m.

REVISED PPP FORGIVENESS PROCESS

Simplified Forgiveness Paperwork for Those with Up to $50,000 in PPP Funding.

Late last week, the federal government announced a new forgiveness application for businesses that received up to $50,000 in PPP funding. The new paperwork includes 1 page of required information and a second page of optional information to apply for forgiveness. As recommended in the past, please consult with the institution that issued your PPP funds on whether to file now or wait, and which application should be used.

Restaurant Covid Guidelines Updated

Guidance recently updated

Industry Guidance for Safely Reopening Restaurants and Bars updates include the following changes related to party size:

Limit party size in dining rooms to 10 people.

Limit party size in bar areas to 4 persons.

Require patrons in all areas to be seated.

Guidance for Safe Celebrations and Events updates clarify the current requirements and includes:

Dancing is not recommended at events and celebrations.

Require everyone to wear face coverings while dancing, if the event includes dancing.

Require social distancing between people from different households while dancing.

Review and follow the updated guidance

Review and follow the new requirements for party size in the Industry Guidance for Safely Reopening Restaurants and Bars.

Bar and restaurants that are open for regular food and beverage service may not allow customers to dance.

Bars and restaurants that host events and celebrations must follow the recommendations for dancing found in the Guidance for Safe Celebrations and Events. Only consider an in-person celebration or event if planners and participants can commit to social distancing by keeping at least 6 feet of space between people from different households at all times and wearing face coverings throughout the celebration or event. The guidance now clarifies that everyone must wear a face covering while dancing.

Attention restaurants and bars

Be on the lookout for potential scammers targeting restaurants and bars claiming establishments owe a fine for masking violations.

What you should know

The Minnesota Department of Health (MDH) has become aware that restaurants are receiving calls indicating that their businesses were part of a scheduled compliance check, and that they owe a fine for masking violations. In a recent incident, none of the state agencies involved in the ongoing enforcement efforts had conducted a compliance check in the area.

What you can do

To protect your business from this scam, be aware that MDH or local public health agencies will work with you over a series of inspections to gain compliance before a fine may become necessary. Inspectors are emphasizing education and awareness, and MDH will not issue a fine on an initial inspection.

If you or someone you know has incurred financial loss due to a scam or fraud, please contact your local law enforcement.

If you have concerns or believe you are a victim of a scam, contact the Office of Minnesota Attorney General Keith Ellison by calling 1-800-657-3787, or submit a Consumer Assistance Request Form or Fraud Report Form.

Wrecking Permit Refunds Possible

Updates to the wrecking permits process

Pre-payment of property taxes will no longer be required for property owners to secure wrecking permits for buildings damaged in the recent civil unrest. Additionally, the City is waiving the associated wrecking permit fees and will not require a survey or pest abatement plans. The City is working with Xcel Energy and Centerpoint to expedite the required utility disconnection verification process.

Staff have begun contacting contractors who have previously submitted wrecking permits to notify them of this change. Property owners who have already submitted permits may be eligible for a refund. If you have questions about the updated process, please contact Development@minneapolismn.gov.

Minneapolis Allows Exterior Security Doors

Retractable Security Doors

Retractable security doors are now allowed to be installed on commercial businesses (no residential uses). No building permit will be required at this time. The City Council is also considering City Ordinance changes. Building permits would be required after those changes to the ordinance. Security doors must be retracted to maintain open views through windows during open business hours. No signage or graphics are allowed on the retractable doors at this time.

The Fed is still haggling over the next package of assistance. It doesn't look like the two sides are close to coming to an agreement.

Language for Liability Protection for businesses and colleges regarding litigation due to contracting covid or having to wear a mask is in the works and has passed through one body.

The state did apply for extra FEMA funding to supplement income for people suffering low income due to the pandemic. Self-employed contractors are eligible for these funds through the unemployment insurance.

Loans available for Minneapolis individuals, businesses and nonprofits affected by civil unrest

Minneapolis individuals, property owners, businesses and nonprofits can now apply for low-interest disaster loans. The U.S. Small Business Administration (SBA) has approved a disaster declaration for areas in Minnesota affected by the recent civil unrest.

Three types of SBA disaster loans

Home disaster loans for homeowners or renters to repair or replace disaster-damaged real estate and personal property including automobiles.
Physical disaster loans to repair or replace disaster-damaged property owned by businesses and nonprofits including real estate, inventory and equipment. Businesses and nonprofits of any size are eligible.
Economic injury disaster loans for working capital to help small businesses and nonprofits meet their financial obligations that cannot be met as a direct result of the disaster.

For help preparing financial documentation, Minneapolis businesses can consult with an advisor through the City’s Business Technical Assistance Program or contact the Minneapolis Small Business Team at 612-673-2487 or SmallBusiness@minneapolismn.gov.

Southwest Businesses Continue to be Hit With Smash and Grabs

Break-ins overnight where windows and doors are smashed and a quick entry to grab whatever may have value continues to be a problem throughout the Southwest business community. Because of the fast nature of these attacks, police are not able to arrive before the suspects have left the scene. We urge all businesses to review your security measures and consider the following:

Join the Southwest Crime Watch Group

SECURITY ADVICE AND REMINDERS FOR BUSINESS OWNERS & MANAGERS

Review your security plans.
Remove all cash from the business leaving cash drawers open and empty.
Post a sign notifying all that there is no cash on site.
Add security window film to your windows and glass doors to prevent glass from breaking/shattering should a suspect throw rock/brick to get in. Uline and local hardware stores should carry this. It is a relatively inexpensive security improvement that would be very effective against current events.
If you're replacing any glass windows or doors, consider a heavier glass that is less likely to smash through easily.
Consider installing bars or roll-cages to the inside of your windows and doors.
Remove or secure items of opportunistic theft, especially items that can be seen and then grabbed by smashing an exterior window.
Remove/Lock up the most commonly stolen items: computers, cash registers, drugs, cash, phones, ipads, liquor, jewelry, cigarettes, and other small valuable or easy to sell items.
Ensure your security system is operational and accessible. Arm it every time someone is not present.
Check to make sure security cameras are working and aimed at the right locations to capture suspicious activity and suspects’ faces.

REMINDERS FOR BEING OPEN LIMITED TO DELIVERY, TAKEOUT AND PICKUP ORDERS

Review your security and staffing plans to ensure a sufficient number of employees are on site.
Review plans for limiting opportunities for crime and insure staff know your procedures for robbery and theft incidents.
Review your policies for cash on hand.
Control access to the establishment for customers coming in for pickups; maintain safe spacing of at least 6-feet between people.
Lock all doors that are not being used for the operation of your limited business.
Secure access to non-public areas, bathrooms and storage rooms.
Train staff to be observant and report suspicious people within or around your business
Check to make sure security cameras are working and aimed at the right locations to capture suspicious activity and suspects’ faces.
If you are using delivery drivers, review safety plans with drivers. Remind them to be vigilant if approached by a stranger on the street.They should never leave the keys in their car and never leave the car running while making the delivery.

Crime Continues

Last week, police were able to track down suspects believed to be involved in the uptick in violent crimes happening in the 5th precinct. Six individuals were interviewed and two were arrested.

Unfortunately, resident reports have come in that armed robberies were attempted in the area over the weekend. This means that at least some of the individuals perpetrating these crimes are still out there and operating.

Please be alert and cautious when arriving and leaving. Keep your personal belongings in zipped pockets or bags. If carrying a bag, wear it cross-body. Have your hands free, and your ears available to observe your surroundings. The police are also recommending to travel in company when possible. The more alert and aware you are, the less likely you are to be the victim of one of these attacks.

Mayor Frey Just Announced that Indoor Bar Spaces will Need to Close Beginning Saturday

Starting 5PM this Saturday, August 1, Mayor Frey is ordering tap rooms, distilleries and night clubs "with a bar area" to close indoor bar areas for regular service. This is in an effort to reduce the spread of coronavirus cases. Health Commissioner Musicant cited 367 cases as of Monday where people testing positive had been in a Minneapolis bar. Restaurant/table areas may continue to operate. Customers will not be allowed to sit/stand at the bar or go to the bar and order directly from the bartender as health officials note that the proximity of people at the bar leads to community spread.

All Remaining Open Streets Events Cancelled for 2020

The City of Minneapolis plans to reconstruct 2 ¼ miles of Grand Ave S between Lake Street and 48th St W. The 60-year-old pavement has reached the end of its useful life and needs to be replaced. With the total reconstruction of Grand Avenue, the City has the opportunity to:

Replace aging infrastructure
Improve safety

We're on the path to opening back up as the Governor acknowledges our suggestions and begins taking the steps to get us back to work. Announcing that the Stay and Home order will be extended by 2 weeks, with a new end-date of May 18th, our businesses will be allowed to offer curbside and delivery service starting this Monday, May 4th.

In order to provide service, you will need to have a "COVID-19 Preparedness Plan" in place. This plan must show how your business will implement the MN OSHA Standards, MDH and CDC Guidelines in your workplace.

Work from home must continue whenever possible.
Ensure sick workers stay home. Your plan must have policies and procedures, including health screenings, that prevent sick workers from entering the workplace
Establish Social Distancing in the workplace
Employee Hygiene

Plan Documentation and Notification Requirements:

Sign Off. The owner or senior management responsible for implementing the Plan must sign and certify the Plan, affirming their commitment to implement and follow the Plan.
Notify Employees. You must provide your Plan, in writing, to all workers, and the Plan must be posted at all of your business’s workplaces in locations that will allow for the Plan to be readily reviewed by all workers. Where physical posting is impracticable, the Plan can be posted electronically, provided that the Plan is received by all workers and remains available for their review.
Training. You must ensure that training is provided to workers on the contents of their Plan and required procedures, so that all workers understand and are able to perform the precautions necessary to protect themselves and their co-workers. This training should be easy to understand and available in the appropriate language and literacy level for all workers.
Supervise. You should also take steps to supervise workers and ensure that workers understand and adhere to necessary precautions to prevent COVID-19 transmission.
Document. You should be demonstrating compliance with this training requirement and documentation must be maintained and made available to regulatory authorities and public safety officers, including DLI, upon request.

You do not need to submit their Plans for preapproval. Upon request, Non-Critical Exempt Businesses must make their Plans available to regulatory authorities and public safety officers, including DLI.

Several Burglaries @ SW Businesses in Past Week.
Smash and Grabs with Bricks Through a Window

The precinct is reporting that there were an additional 4 burglaries in the past 7 days with similar MO (throwing a brick through a window).

RECOMMENDED ACTION: Leave cash registers open so they can see there is no money stored inside, and post a sign saying "all cash has been removed from the premise"

There are window films that can be applied to your windows that are see through and will prevent the glass from breaking. Audible alarms that are triggered by glass are also good deterents.

Video needs to be a good enough quality to be useful. This includes resolution, lighting, and angles.

The precinct is doing extra patrolling of our business areas. If you feel your corner needs additional patrol you can request this by calling the precinct front desk at 612-673-5705.

Grants for COVID response efforts

COVID-19 Community Response Fund

Neighborhood organizations, cultural organizations, nonprofits, businesses, places of worship and faith organizations are invited to apply for grants of up to $15,000 for COVID-19 response activities to take place between May 15, 2020 and December 31, 2020.

Projects can be focused on direct response, support efforts or other byproducts of the pandemic such as food, shelter and health (mental or physical) and safety needs. The intent of the COVID-19 Community Response funds is to support community-led strategies. With that in mind, applicants are encouraged to propose activities that reflect their own expertise, experience, and knowledge and that focus on the specific issues identified within their areas or communities.

To apply, please review the COVID-19 Community Response Fund request for proposals (RFA) for the application and detailed information.

Submit your application by email to health@minneapolismn.gov by April 24, 2020 at 11:59 p.m.

Local, regional, or state government entities are not eligible for funding under this RFA.

Sick and Safe Time Through Pandemic

The City of Minneapolis has issued its interpretation of the Sick and Safe Time Ordinance with regard to the current pandemic:

The Sick and Safe Time ordinance requires the provision of sick leave to workers in the city of Minneapolis. Please be aware that the City of Minneapolis Labor Standards Enforcement Division has posted guidance on its Sick and Safe Time website (and below in bold) to explain how the Sick and Safe Time ordinance is interpreted by the Division during the current pandemic.

A State of Minnesota DEED website also guides businesses and workers during this difficult time, as additional state resources and emergency federal legislation are being rolled out.

**COVID-19 (CORONAVIRUS) and sick and safe time**

An employee's accrued sick and safe time hours are legally protected for their use due to Coronavirus symptoms, testing or infection. Protection extends to the employee and the employee's care of a covered family member. Ordinance protection includes, but is not limited to:

Coronavirus screening;
Care or quarantine due to Coronavirus symptoms or infection;
Testing or quarantine following close personal contact with a Coronavirus infected or symptomatic person;
Covered family members' school or place-of-care closure due to Coronavirus; and
Workplace closure by order of a public official due to Coronavirus.

Importantly, many schools and places-of-care have now been closed due to Coronavirus, which triggers ordinance protection for the use of accrued sick and safe time hours in the city for workers who need to care for their children because of those closures. Similarly, when any public official (e.g. Mayor or Governor) orders business closures due to Coronavirus, that order triggers coverage of the ordinance for workers at those businesses. Otherwise, generally, preemptive closure or preemptive self-quarantine is not covered by the Sick and Safe Time ordinance.

If a worker is infected or symptomatic, they may use any accrued sick and safe time hours. Furthermore, ordinance protection is triggered if a worker has reason to believe they are probably infected. Under those circumstances, as noted in the third bullet (above), self-quarantine ("preventive care" during a global pandemic) would constitute a protected use of accrued sick and safe time.

The Sick and Safe Time ordinance does not apply once a workers' accrued hours have been exhausted. However, employers and employees are encouraged to be understanding and flexible with each other where possible during this emergency. Nothing in the ordinance prevents an employer from providing workers more generous coverage or benefits. The Federal Medical Leave Act or other state or federal law may also apply.

SWBA Brings You Information on Corona Virus Planning

Cities and regions around the world have started enforcing lockdowns to prevent the spread of the much publicized Corona virus. The Minnesota Department of Health and the CDC are urging businesses to be prepared to respond to ill employees and changing situations.

Steps You Can Take:

Clean surfaces regularly. The EPA has compiled a list of cleaning products known to kill this strain of the virus.
Have a Plan for Employee Absence. If the virus becomes widespread here in Minneapolis, you may experience staffing shortages while your employees recover. Consider how you will continue to operate with reduced staff, and consider cross-training staff to help cover for each other. If your employees can perform their work from home, consider allowing them to do so until the spread has been contained.
Protect Your Workers. Review your sick leave policies, and encourage sick employees to stay home to prevent spreading illness to your remaining staff. Encourage anyone you work with to refer to the CDC travel notices before taking any trips.
Protect Your Customers. Consider alternate ways to deliver your products and services without requiring face-to-face interactions during this time. For business that needs to be conducted in person, consider asking sick visitors to wear a mask or wait until they are better. Make hand sanitizers, tissues and other hygiene products available.
Have a Plan for Potential Lockdown. We're hopeful that it won't come to a complete lockdown in Minneapolis to control the spread of this virus, but you may want to plan for the possibility. SWBA is reaching out to city officials to determine if they are considering such a move, and what provisions may be made for small businesses during that time. POLICE NOTICE:
A number of cases of theft from businesses have been happening throughout the precinct. Most recently the suspects have been Juvenile Somali males, but historically this group of suspects cross all ethnicities.

The suspects enter the business as a group and while some may distract staff others are entering employee-only area and stealing from purses, backpacks, and other personal items left in what they believed was a secure area by staff. The other type of theft we have seen are thefts from tip jars that are set on the counter or near the cash register.

PREVENTION TIPS:

Secure areas for staff personal belongings need to actually be secured, maybe lockers or a locked closet

While these groups may come in and be intimidating to some staff, the polite but direct, friendly interaction as a person enters the business (this is the reasoning behind the Walmart Greeter) is often a great deterrent to crime

Consider a tip container on the counter that has a lock on it and is bolted to the counter

Instruct staff to keep their phone in a pocket if it must be on them and keys for the business secured on a lanyard or belt

Do not leave the till open, staff can be easily distracted

Monitor the movement of people that come into the business, be creative with shelving to allow the store to be monitored easily and suspects not to be able to be hidden and allowed to make their way into areas that they should not be in- if you do not have public restrooms, don’t allow anyone into the back area where employee restrooms may be.

Please make sure that the business is not totally reliant on video cameras, often the pictures are not great or the system is not working, please stress how important it is to get good descriptions of suspects especially if there is something unique about the suspect or their clothing.

Wage Theft Ordinance

Over the past few weeks, SWBA has been listening to input from business members, and last week met with co-author Council Member Palmisano to discuss the proposal and share concerns. As good business owners, we're all in agreement that our employees should be paid what they earn.

This ordinance would expand enforcement authority of wage theft issues to the City, and adds a few more requirements, mostly surrounding notification of earned safe and sick time (ESST). Based upon conversations and our meeting, SWBA submitted written comment asking for some modifications that would ease the amount of work to implement the required record keeping changes.

Effective Now

The minimum wage in Minneapolis is scheduled to increase on July 1 each year through 2024. Two increase schedules are in force. The first for small employers, designated as those with 100 or fewer employees. The other for those with more than 100 employees.

The City's Department of Civil Rights oversees enforcement of the municipal minimum wage. The city provides information on the ordinance and requirements.

New Statewide Employment Law Effective July 1

One of the outcomes of the 2019 session is a new wage theft law with portions that impact all employers across Minnesota beginning July 1. Businesses of all sizes and locations across the State are subject to the new law.

One provision you need to be aware of and prepare for is a new employee noticing requirement taking effect July 1 for all new employees. In addition, employers have new requirements for information to be placed on employee earning statements, additional record keeping mandates, and clarifications relating to when employees should be paid.

Nicollet Open Streets isn't too far away, and is the longest running Open Streets event. Please check into participation early and make the most of this event that brings thousands of visitors down our street. If you need help with planning or have questions about participation, Jessica is here to help!

Then there are all the events in between, put on by our neighborhood associations. They will be looking for event sponsors and are usually open to requests and suggestions from local businesses. Inspections Meeting Followup

Thank you to all the owners who joined us for our meeting with City officials regarding business inspections. We had great discussion with leadership and shared our concerns regarding current practices.

This is the first step in building a stronger relationship with city departments that perform business inspections. The goal is to build a foundation of trust and openness in order to improve the process and outcome for both our businesses, the city, and the public as a whole.

Of particular interest was that fact that Health Inspection Supervisors noted that a business can request an inspector to come back later in the week if they stop by at a particularly difficult time. A perfect example of being in the middle of butchering a whole pig when the inspector arrives came up, as it is counter-productive to leave the work sit while walking through with the inspector.

Additionally, many business owners were not aware that they are not required to walk with the inspector on their walkthrough, although the practice is encouraged as many issues can be addressed on the spot or the inspector can offer education and suggestions to prevent future issues.

If you encounter a situation relating to an inspection (fire, health, etc.) that you feel needs to be addressed, please reach out to the Regulatory Affairs Committee for review. The group has helped on an as needed basis with inspection requests, and uses these situations to determine key areas to seek improvements in the city process.

35W Construction - Good News!

Business throughout Southwest has been impacted by the 35W construction project, and there is still a long way to go. With the 35th and 36th St ramps closed, traffic has intensified along Nicollet, and customers not living in the immediate area have been more prone to avoid a visit.

Original plans would have permanently closed the 46th St ramps for a year on top of the closures 10 blocks north. Thankfully, the planners on the 35W project have been responsive to communication, and will now only be closing 46th ramps sporadically as needed - and likely over night and weekend timing when traffic is generally lighter.

SWBA is in contact with the project planners. If you have a specific concern that the construction crews can address, please reach out to us, or directly to the MNDot staff. We'll do our best to help you.

New Inspector at the 5th Precinct

Inspector Huffman shared Precinct priorities and took questions from the audience, learning about some of the more pressing concerns from the business community. The Southwest Business Association strives to enhance community through the power of our small businesses. Strong healthy businesses provide our community with stable job opportunities, lively community connection venues, and greatly impact the identity of our neighborhoods. With this in mind, the Southwest Business Association is proud to announce that we have put together an awards program to recognize business leaders in our community who are focused on these goals and are actively improving our communities.

Business owners, their employees, members of the community and business patrons were invited to nominate business owners for Minority Business Owner of the Year, Woman Business Owner of the Year and Business Owner of the Year for businesses within the boundaries of the Southwest Business Association (South of 31^st Street and West of 35W within Minneapolis city limits). Businesses must operate for a minimum of 3 years for eligibility. Criteria includes demonstration of business strength and growth, and examples of an owners ability to navigate and succeed in the face of adversity. In addition, applicants must demonstrate commitment to community service.

2019 Minority Business Owner of the Year:
Fredrico Navarro, George & the Dragon

When the building at 50^th & Bryant went up in smoke, a little piece of Lynnhurst died – losing two great restaurants. Fred knew just what the neighborhood needed though, and together with his wife, he brought a perfect neighborhood gathering spot with staying power to the neighborhood. Never one to brag, you won’t hear Fred boasting about his charitable activities, but the Navarros always have some program in the works, from supporting local food shelters to encouraging local elementary kids to read with generous gift certificate donations to every child who meets their reading goal. George & the Dragon stands out from the crowd with its consistently good food and service, and that Cheers feel with Fred and his staff able to greet most guests by name. Long after the buzz of being the new restaurant on the block has worn off, George and the Dragon has remained a favorite gathering place for the community – remaining full during the lunch and dinner rushes any day of the week. The Navarros demonstrate great leadership with knowledgeable, friendly, timely and long-term staff, and smart accessible food choices that continue to bring customers in. Their success anchors the corner of 50^th and Bryant and keeps it a busy corner for their neighboring businesses.

2019 Woman Business Owner of the Year:
Naomi Strom, Lake Harriet Florist

Taking on the little flower shop at 50^th & Penn was a second career for owner Naomi Strom. In just a few short years, she has taken a business that was barely recognized to one that is growing exponentially and receiving recognition around the country. While they are a full-service shop, growing traffic from the wedding market has been a huge component to the shop’s new success. Under Naomi’s leadership, the shop has been recognized as “The Best of the Knot” for the past three consecutive years. The shop also took full advantage of the Super Bowl being in town to build relationships with visiting celebrities, leading to continued contracts for appearances and performances in the Twin Cities. Growing from a mom and daughter operation, the shop now employs an additional 3 staff and has a host of contract workers to help in the busy seasons. Naomi regularly supports local educational and religious organizations through in-kind donations for their events and activities. Anyone who knows Naomi can tell you that a large part of the Lake Harriet Florist success is her strong ability to quickly build meaningful relationships with a wide range of personalities from within our community and beyond.

2019 Business Owner of the Year:
Sarah Longacre, Blooma

Sarah Longacre set out to create a business that meets community at the start – with expectant and new moms. These members of our community are at a point in life where they are experiencing major life changes, and it can often be a time of isolation from regular routines and interactions with a large learning curve. Blooma entered the world to provide these critical members of our community a place to gather, learn together and build a tight-knit community of mentally and physically fit families. Her passion to help mothers doesn’t end with interactions at Blooma. Sarah uses her skills and success in business to regularly support organizations with similar missions at home and around the world. Stop by the Boulevard building as a class is wrapping up, and you’ll see the large success this format is. Under Sarah’s vision and leadership in just over a decade, Blooma has grown from one location and a staff of 15 to 3 metro locations and a staff of 65 with a franchise in Nashville and another in Mexico City!

SWBA works to strengthen the relationship between businesses and the local community, serves as an advocate for business owners, and has the ultimate goal of creating a strong and healthy Southwest Minneapolis. We commend these business owners for their leadership and commitment to strong community in Minneapolis. We look forward to recognizing businesses in expanded categories as this new awards program recognition grows.

Bring Your Own Bag Ordinance

The City of Minneapolis is proposing an ordinance that would require customers to pay for bags at the point of purchase if they do not bring their own.

Businesses with a point of sale system would be required to charge a minimum $.05 taxable fee for each bag, and itemize this purchase on receipts.

Want a Parklet Out Front?

Apply Now to Host a Parklet in 2019

The City is seeking community partners to host City-owned parklets for the 2019 season — a new opportunity for the parklet program that launched five years ago. Parklets are unique public gathering spaces built in the right-of-way with seating, plantings and other amenities for people to relax and enjoy city life. You might have enjoyed the cozy, beautiful parklet that Mel-O-Glaze hosted last year.

Participants in the program said the parklets added color and vibrancy to the streetscape, promoted a sense of place and encouraged traffic to slow down. The goal of the parklet program is to activate community corridors with fun public spaces that make neighborhoods more vibrant and support local businesses. Neighborhood organizations, street-level businesses, nonprofits, and community organizations are encouraged to apply by April 5.

City crews will setup the parklets at host locations in the spring after street sweeping is completed and will remove them in the fall. The City-owned parklets include the parklet structure (platform and planter boxes), plantings, chairs, tables, patio umbrellas and public parklet signage. Hosts are responsible for day-to-day maintenance, such as watering plants, picking up trash, taking down umbrellas on windy days, locking up tables and chairs when not in use and reporting any issues.

35W Updates

Upcoming Closures

Expect a couple more overnight closures along 35W in coming days as Minnesota Department of Transportation (MnDOT) crews continue to work on the 28^th Street bridge. 35W will be closed in both directions between Interstate 94 and Highway 62 starting at 10 p.m. tonight, March 22, through 8 a.m. tomorrow, March 23. Both directions of traffic will be closed again between Interstate 94 and Highway 62 between 10 p.m. and 5 a.m. daily from Monday, March 25 through Friday, March 29.

Low Cost Trees Available - They Go Quickly!

Any sign of spring is welcome after these past few weeks, so I’ve got some good news: the City’s low-cost trees program is back! Thanks to overwhelming popularity, the program operates by lottery, open now through March 13. About 800 Minneapolis property owners will get the opportunity to claim a 5- to 8-foot tree to plant in their yard. Large species shade trees are $30 each. Fruit trees and smaller species are $40 each. Comparable trees cost about $125 at a nursery.

The 14 varieties available this year include large species, flowering trees and several kinds of fruit trees. Trees are available to Minneapolis residents, businesses, and nonprofits. Each address is limited to one tree (and a complimentary bag of mulch), with pickup May 18, 19 or 20. Over the past 13 years, the City Trees program has provided 14,000 trees to support our environment and build the tree canopy. Enter this spring's lottery here.

The association has reviewed the plan, taken member comments, and is submitting a letter with recommendations, but you are encouraged to submit individual comments on areas that will impact you and your business as well. You can find the plan online at minneapolis2040.com, and can submit comments using the green comment boxes on the policy pages on the site.

SWBA Identified Policies 54, 58 and 59 as the primary areas that focus on business initiatives. 35W Construction Update: Closures Begin Today

Weekend closure March 2-5

I-35W will be closed south of downtown Minneapolis this weekend while crews remove the 38^th Street Bridge. The closure will start at 10 p.m. Friday, March 2 and reopen by Monday, March 5. The ramps leading to I-35W will start closing at 9 p.m.

Northbound I-35W will close from Highway 62 to I-94. Southbound will close from I-94 to 46^th Street.

The 38^th Street Bridge will close at 6 a.m. Friday and will remain closed for five months while it is rebuilt.

Detour maps are attached for the interstate closure and the 38^th Street Bridge closure.

36^th Street ramp closed through 2021

The 36^th Street ramp will close at 2 a.m. Friday and will not reopen until the project is complete in 2021. We apologize for this inconvenience. I have attached a detour map. Here is why it must remain closed :

During the 38th St. bridge reconstruction, there is not enough room for vehicles to safely merge from the ramp onto southbound I-35W.
Once I-35W freeway reconstruction work begins this summer, the number of southbound lanes will be reduced and shifted at various times while crews work for three years after the 38^th St. bridge reopens. This will make it difficult for vehicles entering from 36^th Street to safely merge onto I-35W south.

City Awards Contract for Reporting on Minimum Wage Impact

During the discussions surrounding a citywide minimum wage increase, one of the key components that SWBA pushed for was good reporting and tracking of the policy's impact. The city included this requirement in its ordinance, and has hired economists with the Federal Reserve to head up the project. The team will be creating a baseline report using data from the past few years. We'll provide updates as more information becomes available.

Council Opts to Put Bag Ordinance on Hold

Following the state ruling that the city could not ban plastic bags, a revised ordinance that would require businesses to charge a minimum 5 cent fee for any bag provided to customers was presented to Council. The council opted not to approve the ordinance and has instead directed the committee to propose other measures that may help reduce the waste stream in the city.

State legislation signed by Governor Dayton yesterday prevents the city from banning plastic bags. The rule still allows the city to mandate a fee for bags distributed however. City staff have commented that there will not be any penalties issued to businesses as they sort out the best way to proceed. As soon as more information is available, SWBA will provide an update.

City Council Directs Staff to Develop Draft Minimum Wage Ordinance

City staff presented recommendations to City Council last week regarding a city specific minimum wage ordinance, and Council has directed staff to move forward with draft language for a Minneapolis minimum wage.

SWBA submitted a report on impact to small business and has also created a short video highlighting three local business owners who discuss how the Minneapolis specific minimum wage might impact their business.

54th Street Reconstruction

We are on the home stretch of construction for the 2016 season. Crews are expecting to wrap up and reopen 54th street before the end of the month.

Due to a heavily rainy season, crews were unable to perform sidewalk construction this year. This means we'll have to expect some closures next season as they return to complete that work.

SWBA has requested to have a meeting with planners and businesses to review how this project season went, and to coordinate for minimum impact during the construction project for next season. If you are a business near the affected area, please watch your email for details as that meeting is planned and scheduled.

City Funded Research Report on Minimum Wage Available

Vote 15 Now Group Petitions City of Minneapolis on $15 Minimum Wage

The activist group Vote 15 Now has submitted a petition to City Council asking that it put a measure on the ballot next election day that would place a mandated $15 minimum wage within the city's charter. Below is the specific language of the petition:

1. Amend Charter Article IV, City Council, § 4.1, Function, by adding a new paragraph (g), Minimum Wage, which shall read as follows:

(g) Minimum Wage. The City of Minneapolis is dedicated to improving its residents’ quality of life. Income inequality, low wages, and a high cost of living relative to other parts of the state are serious economic and social problems facing the City. Many City residents work long hours but cannot afford housing, food, medical care, and other basic necessities. The City has an interest in promoting the health, safety, and welfare of workers, their families, and their communities by ensuring they can support themselves through work. When workers in the City earn decent wages, such wages can also boost the local economy. Therefore, the City chooses to establish a minimum wage to better enable workers to afford the minimum necessities. This minimum wage will be phased in gradually.

(1) Definitions. Terms used in this section 4.1(g) have the same meaning as in the Minnesota Fair Labor Standards Act except as modified herein.

(A) For the purposes of subsection (2) of this section 4.1(g), the number of employees employed by an employer includes the total number of employees (full-time or part-time) working for the employer anywhere in the United States, including, in the case where the employer is a franchisee, all employees employed by other franchisees of the same franchisor.

(B) “Cost of living” shall be measured by the percentage increase, if any, of the non-seasonally adjusted consumer price index (Urban Wage Earners and Clerical Workers, U.S. City Average for all items) or its successor index as published by the U.S. Department of Labor or its successor agency, for the most recent 12-month period for which data is available at the time the cost of living adjustment is calculated.

(2) Minimum Wage.

(A) Employers with 500 or more employees shall pay each employee expected to work 25 or more hours in a calendar year within the geographic boundaries of the City for each hour worked within the geographic boundaries of the City an hourly minimum wage of no less than:

(I) Starting August 1, 2017: $10.00,

(II) Starting August 1, 2018: $11.75,

(III) Starting August 1, 2019: $13.50,

(IV) Starting August 1, 2020: $15.00,

(V) Starting August 1, 2021, and each August 1 thereafter, the hourly minimum wage shall be adjusted to keep pace with the rising cost of living.

(B) Employers with fewer than 500 employees shall pay each employee expected to work 25 or more hours in a calendar year within the geographic boundaries of the City for each hour worked within the geographic boundaries of the City an hourly minimum wage of no less than:

(I) Starting August 1, 2017: $10.00,

(II) Starting August 1, 2018: $11.00,

(III) Starting August 1, 2019: $12.00,

(IV) Starting August 1, 2020: $13.00,

(V) Starting August 1, 2021, $14.00,

(VI) Starting August 1, 2022: $15.00,

(VII) Starting August 1, 2023, and each August 1 thereafter, the hourly minimum wage will not be less than the minimum wage set by subsection (2)(A)(V) of this section 4.1(g).

(C) Gratuities not applied. No employer may directly or indirectly credit, apply, or utilize gratuities towards payment of the minimum wage set by this section 4.1(g).

(D) Sharing of gratuities. The Minnesota Fair Labor Standards Act will govern the sharing of gratuities under this section 4.1(g).

(3) Interpretation. Nothing in this charter shall discourage or prohibit ordinances, rules, or policies providing for higher or supplemental wages or benefits or extending such protections to persons not covered by this section 4.1(g). Case law and standards developed under the Minnesota Fair Labor Standards Act shall guide the construction of this section 4.1(g) and any implementing ordinances or rules.

(4) Enforcement. The City shall enforce this section 4.1(g) and any implementing ordinances or rules. Where an employee or person has been paid less than the hourly minimum wage required under this section 4.1(g), or been subject to any other violation of their rights under this section 4.1(g) or implementing ordinances or rules, including, but not limited to, retaliation for asserting or attempting to assert their rights, the employee or person may bring an administrative complaint with the City, or the employee, person, or City may bring a civil action in a court of competent jurisdiction, and, upon prevailing in either proceeding, shall be awarded the full amount of any back wages unlawfully withheld and an additional two times that amount as damages together with reasonable attorney’s fees and costs, as well as interest on all amounts due and unpaid, and may be awarded an administrative penalty and any additional appropriate legal or equitable relief. Implementing legislation is not required to enforce this section 4.1(g). The City shall enact penalties designed to effectively deter violations of this section 4.1(g), including, but not limited to, penalties that will increase for repeat offenses and will deter employers from engaging in any form of retaliation against persons asserting or attempting to assert rights under this section 4.1(g).

(5) Public Outreach and Education. The City shall implement multilingual and culturally-specific outreach and education programs, including collaboration with and grants to community organizations, to educate employees regarding rights under this section 4.1(g) and any implementing ordinances or rules, or to provide assistance or support to employees or the City in filing and resolving complaints or pursuing other enforcement actions.

(6) Severability. If any portion of this section 4.1(g) is held invalid, in whole or in part, or in its application, by a court of competent jurisdiction, such portion or application shall be severable, and such invalidity shall not affect the validity of the remaining portions or applications of this section 4.1(g).

ADA Lawsuit Adjustment Made at the State Level

Small businesses are often those who open shop in older buildings that don't meet today's ADA standards. With that, more prevalent in recent years, has been a string of ADA lawsuits demanding that businesses perform huge amounts of work to their properties in order to remain open.

Introducing the Southwest Business Association

The Nicollet-East Harriet Business Association would like to introduce you to our new name. Taking a cue from our expanded service area and our popular “Experience Southwest” brand, the organization is excited to announce its new name: the Southwest Business Association.

Those of us who call Southwest Minneapolis home are proud of our neighborhoods. We are drawn to this area for a couple of key reasons, one of which is the healthy and vibrant independently owned small shops and restaurants that flourish in small pockets throughout our area. These businesses are owned by our fellow neighbors and employ Minneapolitans, and if you frequent them you likely have met and built a relationship with the owner. They support our local schools and communities because they are a part of them. They help define our walkable and bikeable neighborhoods. Our local businesses are as much an amenity as are our public parks.

This vibrant and healthy small business economy didn’t just happen organically or by chance. Beginning in 2006, a group of local business owners had a vision to improve our local business districts and formed the Nicollet-East Harriet Business Association. This group of businesses originally resided on or near Nicollet Avenue in the East Harriet Farmstead neighborhood. Their combined effort, along with grants from the City of Minneapolis’ Great Streets program, made a vast difference in the community changing corners such as 38^th and Nicollet into local and regional destinations.

As the years have gone on, the Association has grown to take on larger issues, significantly expanded its service area and assisted businesses from the much broader Southwest Minneapolis area with over 200 business members. Association leadership recognized that a change in name was needed in order to more accurately reflect its members and purpose. We are pleased to announce the Nicollet-East Harriet Business Association will now be known as the Southwest Business Association.

The Minnesota Food Code has been under revision for the past several years. Draft language has been posted online for each chapter. The draft proposed language can be found here for review.
